The Spanish Notary Public intervenes professionally in a multitude of legal acts and businesses, either because the law exceptionally requires that they be formalized in a public deed, as occurs in the case of the incorporation of companies, or generally because the law grants the notarial document attributes some very important effects, given the necessary impartiality, legal preparation, and the character that every Notary has as a public official.
And thus, the notarial document is executive, it provides full proof of the date and fact of its granting, it is a guarantee of the identity and full legal capacity of the persons who sign it and that it has been freely and voluntarily entered into. ; and that is why it is a specially qualified document and as such is subject to registration in the Mercantile Registry or in the Property Registry, as the case may be.
